1. Acceptance of Terms
By accessing or using the with.fizz website (withfizz.netlify.app) or any associated services including Fizz Focus and Fizz Clear (collectively “the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
with.fizz provides free, browser-based tools and content designed to support people with ADHD and focus challenges. The Service includes:
- Fizz Focus — A body doubling and focus timer tool available at fizz-focus.netlify.app
- Fizz Clear — A desktop decluttering tool available at fizz-clear.netlify.app
- Content published on social media platforms (Instagram, Facebook, Threads, TikTok) under the @with.fizz brand
- A newsletter sent via email to subscribers
All tools are provided free of charge. No account registration is required to use Fizz Focus or Fizz Clear.
3. TikTok Integration
with.fizz uses the official TikTok for Developers API to publish video content to with.fizz's own TikTok account. This integration is used exclusively for publishing with.fizz's own content and complies with TikTok's Platform Terms, Developer Terms, and Community Guidelines.
- The TikTok integration is authorized via TikTok's official OAuth 2.0 flow.
- Requested scopes are limited to what is necessary:
user.info.basic,video.publish,video.upload. - The integration does not access, store, or process any TikTok user data beyond the authorized account's own access token.
- with.fizz complies with all applicable TikTok API usage policies. See TikTok's Terms of Service.
4. User Conduct
When using the Service, you agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Attempt to reverse engineer, copy, or redistribute any part of the Service without permission.
- Misuse or attempt to disrupt the Service or associated third-party APIs.
5. No Medical Advice
The content and tools provided by with.fizz are for general informational and organizational support purposes only. They do not constitute medical, psychological, or therapeutic advice, diagnosis, or treatment. Always consult a qualified professional for any health-related concerns.
6. Intellectual Property
All content, text, graphics, and the Fizz character are the intellectual property of with.fizz (Manuela Burger) and are protected by copyright law. Use beyond personal, non-commercial purposes requires prior written consent.
7. Affiliate Links
Some links on this website are affiliate links. If you make a purchase through such a link, with.fizz may receive a small commission at no additional cost to you. Affiliate relationships are always disclosed.
8. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. with.fizz does not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected. Your use of the Service is at your own risk.
9. Limitation of Liability
To the fullest extent permitted by law, with.fizz shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Service. This includes but is not limited to loss of data, loss of revenue, or any damages resulting from reliance on content published by with.fizz.
10. Third-Party Services
The Service integrates with third-party platforms and services including TikTok, Instagram, Facebook, Brevo, Netlify, and Railway. Your use of these services is subject to their respective terms and privacy policies. with.fizz is not responsible for the content, privacy practices, or availability of third-party services.
11. Changes to Terms
with.fizz reserves the right to modify these Terms of Service at any time. Changes will be effective upon posting to this page. Continued use of the Service after changes constitutes acceptance of the revised terms.
12. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts in Germany.
